Forget everything you think you know about spousal support in Ontario’s dual-income households. The idea of “lifetime alimony” often causes stress and confusion, but the reality is far more nuanced under the Spousal Support Advisory Guidelines (SSAG Ontario). If you’re navigating separation and want clarity on how support amounts and duration really work, this guide will clear up common alimony myths Canada-wide and explain what to expect moving forward.

Understanding Spousal Support in Ontario

Spousal support can be confusing, especially with the myths around “lifetime alimony” in Canada. Let’s start by clearing up these misunderstandings.

Debunking Alimony Myths in Canada

It’s easy to assume that alimony means a lifetime commitment. But in reality, spousal support in Canada is not always permanent. Most people think that once spousal support is ordered, it lasts indefinitely. This is not true. In many cases, support is time-limited. The goal is to help the recipient become self-sufficient. Support might be needed for a few months or several years, depending on the situation. But it’s not meant to last forever.

Dual-Income Spousal Support Basics

In dual-income households, both partners often have their own income. This can affect how spousal support is determined. You might wonder how support is calculated when both people earn money. The law considers several factors, like the length of the marriage and the difference in income. Equally important is each person’s ability to become financially independent. Support is not about punishment but about fairness.

Ontario Separation Agreement Essentials

When you decide to separate, a clear agreement helps manage spousal support terms. In Ontario, a separation agreement outlines each party’s rights and responsibilities. It covers support amounts and duration, making future expectations clear. This agreement can prevent disputes and provide peace of mind. It’s essential to involve a legal expert to ensure everything is fair and binding.

Determining Support Duration and Amount

Now, let’s look at how spousal support durations and amounts are decided in Ontario.

SSAG Ontario: What You Need to Know

The Spousal Support Advisory Guidelines (SSAG) are crucial in determining support. They are not laws, but they provide a helpful framework. The guidelines consider income levels, length of marriage, and other key factors. They aim to make support decisions fair and consistent. Understanding these guidelines can demystify the process and help you know what to expect.

Indefinite vs Lifetime Support Explained

Indefinite support doesn’t mean lifetime support. These terms cause confusion. Indefinite support is reviewed regularly and can end when circumstances change. It can be adjusted if one party’s situation improves or worsens. Lifetime support is rare and usually reserved for long marriages with significant income disparities. Knowing the difference can help manage expectations.

The Rule of 65 in Spousal Support

The “Rule of 65” is another important concept. If the marriage length plus the age of the support-seeking spouse equals 65, indefinite support might be considered. This rule recognizes the challenges older spouses face in becoming self-sufficient. But remember, indefinite doesn’t mean permanent.

Navigating Changes and Negotiations

Support terms can change over time. Let’s explore how to navigate these changes.

Spousal Support Review and Variation

Support agreements are not set in stone. They can be reviewed and adjusted. If either party’s circumstances change significantly, a review might be necessary. This ensures the support remains fair and relevant. Whether it’s a new job or a health issue, changes can impact support needs.

Material Change in Circumstances Ontario

A material change in circumstances can warrant a support variation. This could be a loss of employment or a significant income increase. The change must be substantial and long-lasting. It’s not about minor fluctuations. Understanding this can help in anticipating when a review might be needed.

Mediation and Arbitration in Family Law

Sometimes, disputes arise over support adjustments. Mediation and arbitration offer alternatives to going to court. Mediation involves a neutral third party to help reach an agreement. Arbitration is more formal, with a binding decision made by an arbitrator. Both options can save time and reduce conflict.

Frequently Asked Questions

What factors influence spousal support amounts in Ontario?
The law considers income differences, marriage length, and each person’s ability to become self-sufficient. These factors help decide fair support amounts.

Is spousal support always indefinite?
No, indefinite support is not the same as lifetime support. It’s reviewed regularly and can change if circumstances change.

Can spousal support agreements change over time?
Yes, agreements can be reviewed and adjusted if there is a significant and lasting change in circumstances.

Understanding these principles helps demystify spousal support, allowing you to navigate your separation with greater confidence.

Most experienced family law lawyers have faced the situation where a client walks into your office following the breakdown of an international marriage but is still seeking spousal support in Ontario. Whether the law is equipped to address this issue primarily lies on which jurisdiction you practice in. For example, in British Columbia section 161 of its Family Law Act addressed this issue many years ago, which authorizes the court to make spousal support orders even if the marriage was dissolved abroad. However, in Ontario the courts lack jurisdiction to address spousal support despite having jurisdiction to equalize assets and secure child support.

Under binding appellate authority, Ontario courts remain powerless to award individuals spousal support. This statutory void – long criticized by family bar practitioners and trial judges alike—has resurfaced as a pressing issue across Canadian family law. Recent judicial grappling, most notably Justice Alex Finlayson’s detailed critique in Rasaei v. Bahman (2025 ONSC 2074), highlights why the bar must adopt aggressive tactical measures while Queen’s Park and Parliament deliberate legislative reform. Read more.

His reasons challenged the traditional reading of the Family Law Act, suggesting that provincial support regimes could—and should—be interpreted to prevent foreign divorces from extinguishing support rights where equity demands it.

Let’s dive deeper into Land Transfer Tax, a pivotal aspect of buying real estate in Ontario. Whether you’re a first-time buyer or a seasoned investor, knowing how it works is essential.

Basics of Land Transfer Tax

Land Transfer Tax is a fee you pay when you acquire property in Ontario. It’s calculated based on a sliding scale based on the purchase price. The more expensive the property, the higher the tax you pay. If you are buying property within the city of Toronto your LTT is essentially doubled due to the Municipal Land Transfer Tax that is charged by the city of Toronto. Understanding these basics can help you plan your budget effectively and avoid surprises at closing.

Importance for Real Estate Investors

If you’re investing in real estate, Land Transfer Tax can significantly impact your return on investment. It reduces the overall profitability of the purchase. Experienced savvy investors factor this into their calculations to ensure a property is truly a good deal. By recognizing these costs upfront, you can make more informed decisions and prevent unexpected setbacks in your investment strategy.

Naturally, many buyers ask: Is there a legal way to avoid or reduce this tax?

The short answer is yes, but only under strict legal exemptions outlined in the Land Transfer Tax Act.
If you’re a first-time homebuyer, you may qualify for a rebate on your Land Transfer Tax. This can significantly lower your costs. Although many consumers and realtors are familiar with this program not everyone is familiar with the qualification requirements. In order to qualify for this rebate the purchaser must meet the following criteria:

1)      The purchaser must be a Canadian citizen or permanent resident;

This rebate can save you up to $4,000 in Ontario. It’s a great incentive to encourage first-time buyers to enter the market. If you are buying a property within the city of Toronto, the maximum rebate for Toronto is $4475. Learn more about these rebates at the Ontario Government website and the Municipal Land Transfer Tax Rebate

Transferring property between spouses can be exempt from Land Transfer Tax. This applies in situations like adding a spouse to title at some point after the intial purchase. .

This exemption applies so long as no consideration is being exchanged between the parties.

If a mortgage is registered against the property this will not necessarily derail the exemption, unlike a gift transfer described below.

Separating Spouses – Divorce Settlements

If a property is being transferred between spouses pursuant to a separation agreement or divorce, then the resulting owner is exempt from LTT. To qualify, the transfer of property must be according to a formal written separation agreement or court order.

It’s a useful tool to manage family assets without incurring additional taxes. Understanding these exemptions can aid in making strategic decisions during marital transitions

The Land Transfer Tax Act does not specifically exempt gifts of land from LTT. However, if a property is being transferred as a gift for nil consideration to a child and the property is mortgage free, then no LTT will apply. The most important qualification is to ensure there is no consideration being exchanged between the parties and the property is being transferred without any encumbrances (i.e. liabilities) as the assumption of a mortgage would be deemed consideration for the purposes of calculating LTT.

Trustee and Beneficial Owner Transfers

When property is transferred to a trustee or beneficial owner, certain exemptions apply. This is often used in estate planning to manage assets without triggering Land Transfer Tax. It’s a sophisticated method that requires careful planning and legal consultation.

A high level summary of the strategy can be explained as follows:

If a property is purchased in trust for the benefit of a third party (i.e. the beneficial owner) and LTT is paid on the initial purchase, then LTT will not apply to the subsequent transfer when the trustee transfers the property to the beneficial owner or vice versa. In order to be eligible for this exemption you must produce adequate documentation to confirm the nature of the trust relationship which is typically done through a trust agreement.

This scenario is quite common when a parent is added to title for the sole purpose of assisting their child in qualifying for a mortgage. In other words, the parent has no genuine beneficial ownership in the property but was simply added as a trustee in order to assist their child in qualifying for a mortgage. At a later date when the parent seeks to be removed from the title because their child is now eligible to qualify for a mortgage on their own, LTT can be avoided so long as no consideration is being exchanged between the parent and child and documentation exists to confirm the trust relationship.

Additional Exemptions and Considerations

Beyond these standard strategies, there are other exemptions to consider.

Inheritance and Estate Transfers

Inheriting property usually doesn’t trigger Land Transfer Tax. This makes it a valuable tool for estate planning. Proper estate planning ensures that your heirs can receive property without the additional tax burden. It’s crucial to structure your estate efficiently to take advantage of this exemption.

For this exemption to apply, the property must be conveyed from the estate of the deceased to the beneficiary pursuant to a Will or the laws of intestacy. Considering that value of the consideration is nil there would be no LTT applicable. The conveyance to the beneficiary would be exempt irrespective of whether a mortgage exists against the property, unlike a gifted transfer.

Family Farm Exemptions

Family farm properties have special exemptions to support farming as a viable business. If the property meets certain criteria, it may be transferred without LTT. This exemption recognizes the unique role farms play in the economy and supports the preservation of family farming operations.

There is a long laundry list of qualifications to qualify for this exemption and we invite you to schedule a call with one of our lawyers to determine if you qualify.
Businesses undergoing corporate reorganization may qualify for exemptions. This can include mergers, acquisitions, or internal restructuring where property is transferred within a corporate group.

A transfer of land from an individual to a family business corporation would ordinarily attract LTT, but in certain circumstances an exemption from LTT may apply. Many conditions need to be satisfied for this exemption to apply, including the following:

It’s an important consideration for businesses planning large-scale changes.

In Ontario’s highly active mortgage enforcement landscape, private lenders, Mortgage Investment Corporations (MICs), and institutional mortgagees are increasingly relying on default fees, administrative charges, and renewal fees to protect their yields and recover operational costs. However, lenders must be mindful of the fine legal line between a legitimate administrative charge and an illegal penalty.

Under Section 8 of the federal Interest Act, any charge that has the effect of increasing the cost of a mortgage purely because a borrower has defaulted is strictly prohibited. As Ontario courts increasingly scrutinize payout statements prepared by lender during Power of Sale and foreclosure proceedings, understanding how to structure fees—especially mortgage renewal fees—is critical to ensuring enforceability and avoiding costly litigation.

The Legal Framework: Section 8 and the “Substance Over Form” Rule

Section 8(1) of the Interest Act states that no fine, penalty, or rate of interest can be stipulated for, taken, or exacted on any arrears of principal or interest that has the effect of increasing the charge on those arrears beyond the interest rate payable when the mortgage is in good standing.

The Supreme Court of Canada clarified the definitive standard for this rule in Krayzel Corp. v. Equitable Trust Co. The court decided that when determining if a fee violates Section 8, substance must prevail over form. It does not matter how creatively a clause is drafted; if the practical effect of the provision is that the borrower pays more because they defaulted, the clause and/or the fee is void as it will be deemed to be a penalty.

This rule applies to two major categories of lender charges:

1. Administrative and Default Fees

The Ontario Court of Appeal decision in P.A.R.C.E.L. Inc. v. Acquaviva established that standard default fees, late payment charges, and administrative penalties violate Section 8 unless the lender can prove the fee reflects real, out-of-pocket costs actually incurred. If a lender charges a flat $500 “default fee” simply because a payment was missed, without showing $500 worth of actual administrative or legal expenditures, the court will strike it down as an illegal penalty.

2. Automatic Renewal Clauses

A common operational trap involves “automatic renewal” or “deemed extension” provisions. In cases like Cheung v. Moskowitz Capital Mortgage, the mortgage terms stated that if the principal was not repaid at maturity, the mortgage would automatically extend for six months, triggering an immediate 5% renewal fee and a 3% interest rate hike.

The court struck this down. Because the trigger for the fee and the interest spike was the borrower’s non-payment of principal at maturity (an event of default), the automatic renewal was deemed a thinly veiled penalty explicitly designed to circumvent Section 8.

How to Structure Renewal Fees Legally

Lenders do not have to forfeit their ability to charge renewal fees or increase interest rates as a mortgage nears maturity, but the mechanism must be tied to the passage of time, not the occurrence of a default.

The Passage-of-Time Exception

The Supreme Court in Krayzel unanimously affirmed that a step-up interest rate or a scheduled fee tied strictly to a calendar date is completely lawful. If a mortgage agreement states that the interest rate is 8% for the first 11 months, but automatically steps up to 12% in month 12 and remains 12% thereafter, this does not violate Section 8. The higher rate applies whether the borrower is in default or not; it is driven entirely by time.

To safely structure a renewal fee without triggering Section 8, lenders should utilize one of two frameworks:

Option A: Lenders should make best efforts to avoid including automatic renewal clauses that are triggered by virtue of the borrower failing to make payment on the maturity date. Instead the mortgage commitment or loan agreement ought to include a provision that speaks to renewal at mutually agreed upon terms. Therefore upon the maturity date the borrower and lender will be required to enter into a renewal agreement whereby the Lender can demand a lender fee and/or increase the interest rate from the previous month.

Option B: In the alternative, the Lender can draft the loan agreement in a manner whereby a step-up in the interest rate is triggered by virtue of the passage of time and as a result of the borrower failing to repay the loan upon maturity. For example: “The interest rate shall be 8% from inception until August 1. From August 2 onward, the interest rate shall be 12%.” If maturity is August 15, the rate increases naturally due to time, meaning the post-maturity rate is identical to the pre-maturity rate, perfectly satisfying Section 8.

First Source Financial Management Inc., this explicit language significantly aids collectability, provided the fees remain proportionate and are in fact found to be reasonably incurred by the Lender.

In Ontario, this usually means initiating a Power of Sale or Foreclosure proceeding.

However, full-scale mortgage enforcement can be time-consuming, expensive, and subject to procedural delays. For many lenders, there is a faster, more cost-effective mechanism to stabilize the loan and secure a clear path to repayment: a Forbearance Agreement.

Understanding Ontario Mortgage Default

A forbearance agreement (sometimes called a standstill agreement) is a legally binding contract between a lender and a defaulting borrower. Under this contract, the lender agrees to temporarily pause or delay their right to enforce the mortgage security (such as selling the property under Power of Sale) for a specific, defined period.

In exchange for this breathing room, the borrower agrees to meet strict new conditions, rectify deficiencies, and adhere to a structured repayment schedule

Important Distinction: A forbearance agreement is not a forgiveness of the debt, nor is it a permanent loan modification. It is a structured contract that formalizes a temporary pause in enforcement while strengthening the lender’s legal position if the borrower ultimately fails to pay.

When a borrower defaults on a mortgage in Ontario and the mortgage/charge has been registered against real property, a secured lender must act quickly to protect their investment. While foreclosure is an option, the vast majority of institutional and private lenders utilize the Power of Sale process because it is significantly faster and allows the lender to recover their capital without taking permanent title to the property.

Understanding the rigorous legal timeline from the initial default to the execution of a Writ of Possession is essential for realtors, mortgage brokers, and lenders alike. Managing these timelines, including the accumulation of interest and other costs becomes paramount when the market is in a downward cycle of depreciation or stagnation, when property values are not increasing as expected.

The four steps to mortgage enforcement are described below.

The enforcement process is triggered the moment a borrower breaches the mortgage covenants. While a default usually involves missed principal and interest payments, it can also stem from a failure to pay property taxes, maintain home insurance, or keep the property in good repair.

Before launching formal statutory proceedings, lenders typically have their legal counsel issue a Demand Letter. This gives the borrower a brief window (often 10 to 15 days) to cure the default, failing which the full balance of the mortgage is accelerated and becomes due immediately.

Step 2: Issuing the Notice of Sale

If the default remains uncured, the lender can issue a Notice of Sale Under Mortgage pursuant to the Mortgages Act.

During these 35 days, the lender cannot take further legal action, giving the borrower a statutory right to pay off the arrears or refinance. A borrower can stop the mortgage enforcement process by paying the outstanding mortgage arrears plus the lender’s reasonable legal costs to reinstate the mortgage.

To establish the tort, a plaintiff must prove three elements: the conduct arose in an intimate partnership or its aftermath; the defendant intentionally engaged in the conduct; and the conduct, on an objective measure, constitutes coercive control.

In traditional intentional torts, intent can often be inferred from the act itself; some worry this framing will make it harder to secure damages if a defendant claims they did not “intend” to overpower the other’s will. In a move aimed directly at the housing affordability crisis, the provincial government’s March 2026 Budget—in coordination with federal partners—introduced a massive expansion to the HST New Housing Rebate. For those navigating the real estate market, this isn’t just a minor update—it is a six-figure game changer that requires precise legal timing.

Starting a business in the GTA means facing tough choices about incorporation and legal agreements that can shape your company’s future. Sorting out Ontario versus federal incorporation, drafting key contracts, and keeping up with compliance can quickly become overwhelming. This guide breaks down those essentials clearly, so you feel confident making the right decisions from day one.

When starting a business in the GTA, one of the first decisions you’ll make is how to incorporate. This choice affects your company’s structure and operations.

Ontario vs Federal Incorporation

Choosing between Ontario and federal incorporation involves weighing specific benefits. Ontario incorporation offers a straightforward process with direct provincial regulations. It can be more cost-effective for businesses only operating within Ontario. Conversely, federal incorporation provides a broader business name protection across Canada, which is crucial if you plan to operate or expand nationally. Consider where you envision your business in the next five years as you make this decision. Many believe federal is always better, but for a local business, Ontario might be the right fit.

A NUANS search is a critical step in the incorporation process. This search checks if your desired business name is already in use. It’s mandatory before registering a new name to ensure exclusivity. Conducting this search helps you avoid trademark infringement and/or being sued by another company with a similar name that registered before you did.

Understanding Corporate Bylaws

Corporate bylaws are the internal rules your company will follow. They cover everything from director roles to shareholder meetings. Having clear bylaws helps prevent disputes and keeps your business running smoothly. Think of them as the rulebook for your company’s operations. Without this clarity, even small misunderstandings can escalate into significant issues, which will invariably take more time and resources to resolve at a later date.

Most estate plans use generic documents that can leave your assets vulnerable and your wishes unclear. Without a tailored approach, you risk exposing your estate to unnecessary taxes and probate delays in Ontario. This post explains why estate planning in Toronto and Vaughan demands a customized strategy to protect your legacy, support your loved ones, and keep your business running smoothly. Read on to learn how Vakili Law Group can help you create a plan designed specifically for your needs.

Importance of a Tailored Estate Plan

Creating a customized estate plan is crucial for safeguarding your assets and ensuring your wishes are honored. A well-crafted plan offers protection that generic documents such as Will kits can’t match.

Risks of Generic Documents and/or Will Kits

Standard estate documents often lack the precision needed to protect your assets. Without a personalized approach, you may unintentionally expose your estate to challenges. For instance, a generic will might not address specific family dynamics or unique asset types. This oversight can lead to disputes among heirs, unnecessary taxes or long delays. Many people believe a simple will is enough, but that’s a misconception.

Safeguarding Assets and Legacy

A tailored estate plan helps preserve your wealth and legacy. By customizing your documents, you ensure that your estate reflects your true wishes. This includes setting up trusts to protect assets from creditors or unforeseen expenses. When your plan is personalized, you have control over how your assets are distributed. This specificity prevents conflicts and maintains family harmony. Knowing your legacy is secure brings peace of mind.

Reducing Probate and Tax Exposure

Customized estate plans can minimize probate delays and tax burdens. By using specific strategies, such as trusts and dual wills, you can reduce the time and money spent on probate. These tools allow assets to pass more quickly to your beneficiaries, bypassing lengthy court processes and maintaining privacy when necessary. Tailored plans can also address tax concerns. For instance, careful planning might help lower the Estate Administration Tax in Ontario. Most people overlook these advantages, but they’re essential for efficient estate planning.

Key Components of Customized Planning

Tailored estate planning includes several key elements that ensure comprehensive protection. These components address various aspects of your estate, from asset distribution to business continuity.

Dual Wills and Trusts in Ontario

In Ontario, using dual wills can be a smart strategy. This approach separates personal and business assets, reducing probate fees on certain assets. By having two wills, you can ensure that your business remains operational with minimal disruption. Trusts play a vital role in protecting assets and providing for loved ones. They offer flexibility in managing your estate, allowing you to set terms and conditions for asset distribution. Trusts can also protect minors or beneficiaries with special needs. Understanding these tools is essential for a robust estate plan.

Business Succession and Continuity

For business owners, a succession plan is crucial. It outlines how your business will continue after you’re gone. This planning ensures that your company’s operations remain smooth, protecting your employees and customers. A well-thought-out succession plan can identify potential leaders and provide them with the necessary training. It also addresses financial considerations, such as transferring ownership. Without a plan, your business may face uncertainty or even collapse. Most assume their family will handle everything, but a clear plan is vital for continuity.

Guardianship and Digital Assets

Appointing guardians for minor children is a critical part of estate planning. This ensures their care and upbringing align with your values. Additionally, in today’s digital age, managing digital assets is essential. Digital assets include online accounts, digital currencies, and social media profiles. Without proper instructions, these assets can become inaccessible or lost. A customized plan includes specific directions for handling digital assets. This foresight protects your digital legacy and ensures your wishes are carried out.
